BoostWorks Terms of Service

These Terms of Service (“Terms”) govern your access to and use of services provided by BoostWorks (“BoostWorks,” “we,” “us,” or “our”). By purchasing, accessing, or using our services, you agree to be bound by these Terms.
If you do not agree, please do not use our services.
1. Services Provided
BoostWorks provides professional digital services including, but not limited to:

Social media management

Paid advertising management
-
Website design and development
-
Automation and software integrations
-
Email and SMS marketing
-
Consulting and strategy services
Specific deliverables, timelines, and scope are outlined in each client’s proposal, invoice, or service agreement.
2. Client Responsibilities
To ensure successful delivery, clients agree to:

Provide accurate information and timely access to accounts, assets, and approvals

Respond to requests within a reasonable timeframe
-
Maintain ownership or proper authorization for all provided content, accounts, and data
-
Comply with platform policies (Google, Meta, Shopify, etc.)
BoostWorks is not responsible for delays or performance issues caused by incomplete information, delayed responses, or restricted access.
3. Payments & Billing

All fees are due upfront unless otherwise agreed in writing
-
Monthly services are billed on a recurring basis
-
Late payments may result in paused or terminated services
-
All payments are non-refundable except as outlined in our Return & Refund Policy
Advertising spend is separate from service fees and is non-refundable once allocated.
4. No Guarantee of Results
BoostWorks provides strategy, execution, and optimization services. However:

We do not guarantee specific outcomes such as sales, leads, revenue, ad performance, rankings, or engagement
-
Results depend on many factors beyond our control, including market conditions, budget, competition, platform changes, and client responsiveness
By using our services, you acknowledge and accept this risk.
5. Intellectual Property
Unless otherwise stated in writing:

BoostWorks retains ownership of all strategies, frameworks, templates, processes, and internal tools

Clients retain ownership of their original content and brand assets
-
Final deliverables are licensed for client use upon full payment
BoostWorks may showcase non-confidential work for portfolio or marketing purposes unless otherwise requested in writing.
6. Third-Party Platforms & Tools
BoostWorks works with third-party platforms including, but not limited to:

Google Ads
-
Meta (Facebook & Instagram)
-
TikTok
-
Shopify
-
Klaviyo
-
Gorgias
BoostWorks is not responsible for:
-
Platform outages or policy changes
-
Account suspensions or bans
-
Changes in pricing, algorithms, or ad delivery
Clients agree to follow all third-party platform terms.
7. Termination
Either party may terminate services in accordance with the agreed notice period.
BoostWorks reserves the right to terminate or suspend services immediately for:

Non-payment
-
Abuse or harassment
-
Violation of platform policies
-
Misuse of services
-
Breach of these Terms
No refunds will be issued for terminated services once work has begun.
8. Confidentiality
Both parties agree to keep confidential any non-public business, financial, or strategic information shared during the engagement, unless required by law.
9. Limitation of Liability
To the fullest extent permitted by law:

BoostWorks shall not be liable for indirect, incidental, special, or consequential damages
-
Total liability shall not exceed the amount paid to BoostWorks in the prior 30 days
Clients agree to use services at their own risk.
10. Indemnification
Clients agree to indemnify and hold harmless BoostWorks from any claims, damages, or losses arising from:

Client-provided content or data
-
Violation of laws or platform policies
-
Misrepresentation or unauthorized use of assets
11. Modifications
BoostWorks reserves the right to update these Terms at any time. Continued use of services after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.
